Service Terms

Booking, payment, delivery, image licensing and print returns.

Last updated:

These terms apply to all services provided by Anthony Bogucki, doing business as Bogucki (“I,” “me”), to the person or business placing an order (“you”). They are published at bogucki.photo/terms. Contact: hello@bogucki.photo · (313) 380-3226. I carry general liability insurance; certificates of insurance are available on request.

01 Acceptance and scope

You accept these terms by ticking “I agree to the terms,” paying an invoice, signing a Project Contract or purchasing a license upgrade. A Project Contract takes priority where it conflicts with these terms. The version posted when you order applies to that order.

Your order includes only what is listed on your order page, quote, invoice or Project Contract: typically the listed images or SKUs, the described style, backgrounds and angles, standard retouching (color correction plus dust, blemish and background cleanup), two revision rounds and the everyday-use license. Anything else, including extra images or angles, video, complex compositing, 3D models, and RAW, PSD or CGI scene files, is quoted separately.

02 Payment

  • Instant-pay jobs are paid in full at checkout. Work begins once payment clears.
  • Projects of $500 or more require a 50% non-refundable deposit to reserve the date. The balance is due before full-resolution delivery.
  • Prices are in U.S. dollars, plus any applicable sales tax. I may pause work on any invoice more than 14 days past due.
  • Payments in bitcoin receive 6% off the creative fee or print price (not extras, licensing, rush, shipping or sales tax). Refunds of bitcoin payments are made only in the USD equivalent of the amount at the time of purchase, less any non-refundable processing fees.
  • Payment concerns must be raised with me first. A chargeback or dispute filed without doing so suspends your license until resolved.

03 Delivery, revisions and rush

  • Proofs are watermarked, low-resolution previews and not for publication. Full-resolution downloads unlock once the final invoice is paid.
  • Galleries expire 90 days after delivery and may then be deleted. Downloading and backing up files is your responsibility; any archive I keep is a courtesy, and re-delivery may carry a fee.
  • Two revision rounds are included; additional rounds are $50 each. A round is one consolidated set of feedback on any or all images. Revisions adjust delivered images (color, cropping, retouching). Brief changes after the shoot, such as new angles, props, backgrounds or a reshoot, are new work.
  • Rush: +25% of the order total for delivery in under 5 business days; +50% for under 48 hours. Rush timing starts once I have payment, products and everything needed to begin, and is subject to availability confirmed in writing.

04 Cancellation and rescheduling

  • Instant-pay jobs: fully refundable, less non-refundable processing fees, until work begins; non-refundable after that, and the order will be completed.
  • Deposit projects: the deposit is non-refundable on cancellation. One reschedule is free with at least 7 days’ notice, moving the deposit to a date within 90 days. Shorter notice or a second reschedule may require a new deposit.
  • Late cancellation: within 48 hours of the shoot, or once shooting has begun, work completed and non-refundable expenses already incurred (such as props, rentals and booked crew) are also billed.
  • If I must cancel due to illness, emergency or equipment failure, I will offer the first available date, or refund all payments for undelivered work if no date can be agreed.

05 Licensing

I retain the copyright to all images I create. Your license takes effect once you have paid in full.

Everyday use (included)

A non-exclusive, worldwide license with no time limit to promote and sell your own products and business on your website; marketplaces and online stores such as Amazon, Shopify and Etsy; organic (unpaid) social media; sales decks and presentations; and printed sales materials such as flyers, sell sheets and catalogs. Non-exclusive means I may license the same images to others; I do not resell client product images in practice, but that right is reserved unless you buy Exclusive or Full buyout.

You may crop, resize, and add text, logos or graphics. Please consult me before major alterations, such as compositing, heavy retouching or changing the product’s appearance.

Not included: paid advertising, packaging and large-format print (see upgrades); reselling, sublicensing or stock use (your agencies, designers, printers and retailers may use the images on your behalf); training AI or machine-learning models; and use in trademarks or logos.

Upgrades

Priced as a percentage of the creative fee (my fee for photography and editing), never on expenses, and after any volume discount. Paid ads and Print & packaging can be combined; Exclusive and Full buyout replace them.

TierWhat it addsOf creative fee
Everyday useThe uses listed aboveIncluded
Paid adsPaid digital and social ads, sponsored marketplace listings+50%
Print & packagingPackaging, labels, in-store and point-of-sale displays, billboards, large-format print, paid print ad placements+100%
ExclusiveAll of the above, and I will not license the images to anyone else+200%
Full buyoutUnlimited, exclusive use in any media, worldwide, with no time limit+300%

You can upgrade later and pay only for what you add. For example, on a $1,000 creative fee, adding Print & packaging (+$1,000) to Paid ads (+$500) costs $1,000, and moving from both to Exclusive (+$2,000) costs $500. Copyright remains with me under every tier, including Full buyout, unless transferred in a separate signed agreement.

06 Client-supplied photos

When you supply photos for retouching, you confirm that you own them or have permission to have them edited and used as intended, including from anyone pictured, and you are responsible for any claim otherwise. No license fee applies; the images remain yours and editing gives me no ownership. I am not responsible for limitations of the original file, such as low resolution, blur, noise, poor lighting or compression, and will advise you before starting if a file is unlikely to edit well.

07 Expenses

Expenses are billed in addition to the creative fee. I will seek your approval before they exceed my estimate by more than 10%.

  • Props: cost + 15%; available to you on request once the project is paid. Styling: $75 per hour.
  • Travel: $0.75 per mile, round trip, beyond 30 miles of Shelby Township. Parking, tolls and overnight costs at cost, agreed in advance.
  • Assistants, models, hair and makeup, locations and rentals: billed separately, as quoted.

08 Client products

  • Drop-off and shipping: local drop-off and pickup at my Shelby Township studio is free. You pay inbound shipping; return shipping is charged by size, weight and distance and quoted before dispatch. Products should arrive clean and camera-ready, with spares of anything small, fragile or perishable.
  • Care: products are handled with care and stored indoors in a secure studio. Opening packaging, removing tags, light handling marks and using up food, cosmetics or other consumables are a normal part of production, not damage.
  • Liability: for loss or damage caused by my negligence, my liability is limited to the lesser of the product’s wholesale replacement cost or the order’s creative fee. I am not responsible for hidden defects, inadequate packaging or carrier damage. You must insure shipments, and must disclose high-value, one-of-a-kind and prototype items in advance and keep them insured.
  • Collection: products must be collected, or their return arranged, within 30 days of delivery. Products left more than 60 days, after reasonable attempts to contact you, may be donated, recycled or disposed of.

09 Portfolio and releases

I may display work created for you in my portfolio, website, social media and award entries, unless you purchased Exclusive or Full buyout, an NDA is in place, or your Project Contract says otherwise. On request, I will hold unreleased products until launch. Client-supplied photos are never displayed without permission. You are responsible for permissions covering people, logos, artwork or locations you provide, and for all claims made about your products. When I hire models, I obtain releases covering your license.

10 Limitation of liability

To the fullest extent permitted by law:

  • My total liability for any claim relating to an order is limited to the amount you paid for that order. Client products are limited as set out in section 08.
  • I am not liable for indirect losses, such as lost sales or profits, missed launches or marketplace listing issues.
  • If events beyond my reasonable control (such as severe weather, illness, outages or carrier delays) prevent delivery, my sole obligation is to reschedule or refund the undelivered portion of the order.
  • Nothing in these terms limits liability that cannot be limited under Michigan law.

11 Law, disputes and general

  • Governing law: Michigan. Before filing any claim, both parties will try in good faith to resolve the dispute within 30 days of written notice. Unresolved claims go to the state courts of Macomb County, Michigan, or small claims court where eligible.
  • General: if any part of these terms is unenforceable, the rest still applies, and a delay in enforcing any term does not waive it. Your license may not be transferred without my written consent, except with the sale of your business or of the product line shown.

12 Privacy

I keep your name, email, and order or project details to complete your order, deliver files, and follow up on your project. Payments are processed by Stripe; I never see or store your full card number. I don’t sell or share your information, except with the vendors needed to fulfill your order (such as the print lab). After a print purchase, Google Customer Reviews may ask if you'd like to rate your experience. If you opt in, Google receives your email, order number and estimated delivery date to send a short survey. Email me anytime to have your details deleted. See my privacy policy for details.

13 Prints: returns and replacements

Prints are made to order by my print lab and shipped straight to you, so they follow the lab’s replacement policy.

  • Damaged or defective: if your print arrives damaged, or has a printing or workmanship defect, email hello@bogucki.photo within 14 days of delivery with your order number and a photo of the print and the box it came in. I’ll have it reprinted and sent again at no cost to you. No need to send it back unless I ask.
  • Lost or late: if your order hasn’t arrived within a reasonable time after its expected delivery, email me and I’ll work with the lab and the carrier to sort it out.
  • Change of mind: because each print is made to order, I can’t accept returns or give refunds for a change of mind or for choosing the wrong size, material or frame. Please check your order before you pay.
  • After 14 days: problems reported more than 14 days after delivery aren’t covered.
  • Canada: the same policy applies. Import duties, taxes and Canada Post fees are paid by you on delivery and aren’t refundable.

This section covers prints only. Refunds for photography and retouching services are covered in the sections above (see section 04).
